The neighbor has a hedge between our properties, it was always taken care of by the neighbor until she passed away about 15 yrs ago. The new owner rents the home and they say it isn't their responsibility to trim, I wrote the owner and was ignored,it is up in my fruit trees and about 3 feet into my yard and about 15 ft tall in places, so 3 years later I asked my son to cut it to a reasonable height for me, now we have filled 12 cans and 2 90 gal cans full and still have weeks of clean up in my yard since the pick up is once a week, My question is, do we have to clean the neighbors yard of debris since it is their hedge encroaching in our yard or are they responsible for it?
I have 1 90 can a week that can be picked up and will take several weeks to get rid of my yard mess they have a pick up and 2 teen boys which would take them a 1/2 day, can I bill the home owner for 3 days of 2 people working on it to get it off my property

If you had a professional service trim the hedge and do the cleanup you could bill the owner. You would have had to inform him that you were doing it first. If he refused to pay you could sue. But doing the work yourself doesn't allow for that.

You have the right to trim any shrubbery that encroaches on your property.

Yes, if you got a estimate from a professional service prior to doing this, if you notified the owner of the property in writing that you would be doing this.

But in general you can cut it back to the edge of your property, you can not go onto their property and cut anything, You can not cut any part of it, that is on their property.

So what you are saying I can only cut 1/2 way to flatten top of hedge it will be 5 ft. to about the middle than about 15 ft on the prop line looks rediculas but that is how we will leave it, I still have weeks of debris to get rid of, what ever happened to taking pride in your own yard and not let overtake your neighbor. Im 60 yrs old and just do not have the energy to cut the neighbors side of to do the clean up, thank you so much for your comments I really appreciate it.

Nor, strictly speaking, do you have the right to cut the neighor's side.

If hauling off the trimmings is the problem, I would consider throwing them over the hedge, if it were me.

Edit: forget that, 15' is quite a throw, isn't it?

I think we are missing the point. If anyone plants a hedge on your property it is YOURS. You can do what you want with it and I'd do something before the new owner tries to exercise adverse possession. Where are you located? If the hedge is on your side of the line just cut it but don't think you can bill anyone, its your hedge.

Anything that is on, or over your property you can cut, anything on or over their property line can not be cut.

I am thinking the bases of the trunks are on the neighbor's property (Only 3' over the property line and 15' tall would be a mighty skinny hedge.)

But yes. If the trees or shrubs which make up the hedge come out of the ground on OP's property, by all means: cut the sucker down and spray the stumps with weed-killer.

I frequently agree with Chuck but diverge on one point. Tree on your neighbors property that reaches over the property line is in your air space. Draw an imaginary line straight up from the line and you can legally cut anything over the line.
