    Hi,

    I was on F1 Visa till September 2008. From October 2008 I was on H1-B visa. I started working on OPT from Jan 2008. In 2009 I just filed 1040NREZ and 8843 myself. But recently someone told me that I should have filed in dual status and that would have maximized my refund. Is that true? If so, can I re-file my 2008 tax returns this year? Thanks for the advice.

    You may submit an amended return (Form 1040X) to receive additional refund any time up to 3 years after the original due date of the return. So that means for your 2008 return you have until April 17, 2012 to file an amended return, or if you filed for an extension on your 2008 return you have until October 15, 2012.
