    Interference with custody.
My ex wife dropped of the our three children with me 10, 8, & 5. On 1/4/2012. Out of the blue she filed for a warrant for interference with custody. We have joint custody with her having physical custody. The Judge reset the hearing for one week and she has made no attempt to pick the children up. Is there any thing I can file to get a temporary order of custody? This case is in Ga.

You should file for custody in your response if she has dropped them off and hasn't contacted the children since.

So you counter file for custody. You show the court, that she dropped the children off and has made no attempt to retrieve them.

The judge is going to figure someone's lying. So make sure you have witnesses.

Feel sorry for the kids, being caught up in this. The 10 year old and the 8 year old may need to testify. You show that she dropped them off, you have been taking them to school, or letting her talk to them on the phone, they testify she has not tried to come get them.

She would know where they are at, she would know the school they are in, so she could merely pick them up from school.

But you should first have an attorney, don't dare handle this without one, next you file for a change in custody giving you primary custody of the children
