    Hi,

    I came in US in October 2010 as a post doc with a Visa H1-B. I am an employee of the university. I receive every year a W-2. In 2011 I filed my tax return on-line (form 1040) and did the same in 2012. I got money back for each year.But I learn recently about the tax treaty between France and the USA for the tax exemption. Here are my questions.

    I wonder if it works for H1-B?

    Do I have to file Form 1040X, Form 1040NR-EZ, form 8233 for 2010 and 2011?

    On the 1040NR-EZ if my wages,salaries,tips,etc... is 10000USD. Does it mean that my total income exempt by the treaty is 10000USD?

    The tax treaty does not apply to income earned while on a work visa.
