    How do I evict my boyfriend?
    Me and my boyfriend of 4 years recently broke up, however he won't leave my house. Ive called the cops to have him removed only to be told that because I let him stay there he don't have to legally leave. He don't pay anything and his name is not on the lease for the house I rent. My landlords won't evict him either and I need him gone.. What do I do?

    He's legally a tenent and has every right of a tenant... you have to have him served legally according to your states law. Since we don't know where that is a wild guess is a minimum of 30 days notice.

    Even though he is not on the lease and doesn't pay rent, he has established residency and has to be treated as a tenant. Since he moved in under your lease you are considered the sublandlord and he is the subtenant. That's why you have to evict him, rather than your landlord.

    First you have to give him a written notice that his tenancy is terminated and he must move out with x days. The time depends on the laws of your location. Tell us what state you're in and we'll tell you how long the time must be. Make sure you keep a copy of the notice.

    If he hasn't moved out by the end of the notice period then you have to file a lawsuit for eviction. The court will assign a trial date and at trial if he doesn't have any defense then the judge will grant you a judgment for eviction. If he still hasn't moved out at that point then you can make arrangements with the sheriff or constable to have him evicted.
