    Can someone be released if charges are dropped?
    My husband received 3 yrs probation, on that same day he got into a fight with his bother. His brother pressed charges on him. Now its been a couple of weeks and he went to visit his PO for the first time and the arrested him/well they say it is a probation hold. His brother now wants to drop the charges so that he can be released. What will happen now? Can he be released if the charges are dropped...

    Hello t:

    Yes, he CAN, but it's the prosecutor who's going to press charges - NOT his brother. And, even if the charges are dropped, he may be guilty of a probation violation, and they'll keep him till they have a hearing.

    The brother can not just drop the charges, if the brother did not want him charged he should not have called the police. The brother can testify at his hearing.
