    Hi,

    I was on F1 visa till Sept 30th 2011 and on H1b from Oct 1st 2011. I did not qualify the substantial presence test and have to file 1040 NR-EZ.

    I wanted to know what deductions I can claim (Standard or Itemized) on Line 11 in the form.
    I called IRS and they told me since I was not on F1 for the entire year, I cannot claim standard deduction? Is this true? I know a lot of people in my situation who claimed standard deduction.

    I am really confused. Pleas help!

    There is no standard deduction for nonresidents. As you can see from the form you must use itemized deductions.

    Actually, students and trainees from India DO get to claim the standard deduction under the U.S.-India Tax treaty.
