My tenants moved out without notice (found out because we own another home across the street being renovated), they were on month to month basis what are the recourse if any to our tenants? We do have the deposit and they did leave damages, did not clean, left trash? Everything was in the contract including that they go month to month notice and have to give noticed before leaving.

Depends on what state or country you are in, but in general if you give them due notice, you would be able to deduct damages and cleanup expenses, as well as the monthly rent for which they are liable.

I am located in Charleston SC, they paid for the month of Feb and moved out without noticed between the 29 and March 2nd. I don't know exactly which date but I know they were gone on the 3rd of March. We did not give them notice because they left on their own and we never knew thew was leaving. Do we still have to send out a letter to them even though they left on their own without notice? Or should we just apply the deposit to the damages, cleaning expense and leave it at that? What is our options to pertect ourselves?

Take a ton of pictures, make a list of everything damaged and an itemized list of materials and labor to repair. A professional estimate is better if you end up in court. Follow the SC laws Local Tenant Rights, Laws, and Protections: South Carolina You can also try to sue for the March rent since they did not give notice but this is frequently an empty experinec for most LLs. BTW you can't just apply their deposit to anything. If they damages things then the pics and list will show how much you can take but they must be given the itemized list and charges. The March rent can't just be taken from the deposit unless you had a written lease that say that could be done.
