Hi, I have just filed for divorce from my wife, for I feel that she is an unfit mother. My 3 year old has already taken some of my wife's medicine that was not put up. These medication are for antidepressant pills and also prevent suicidal thoughts. My wife has taken 13 different kinds of pill, going from doctor to doctor to clinics even driven to San Antonio from Houston to get more pills. My house is falling apart and I am scared that I could lose my girls in this divorce. I have a addict wife! What are my chances.

If you can prove that she is addicted and that she is careless about leaving the meds around, then you stand a good chance of getting primary custody. Have you discussed this with your divorce attorney?

So have you moved out and taken your child with you at this point?

You will have to prove her unfit, so when the child took the pill did someone rush her to the ER so there will be proof of this ?

Merely being sick and going to the doctor a lot does not make you unfit, so her going to many doctors is not unfit, you will have to get a doctor or doctors to come in and testify in court that she is addicted and that she is taking more medication than she should and so on.

I have spoken to my attorney about this and have provide him pictures of her pill boddles and a hosp record of a time my daughter got into her antidepressant midication and started to throw up. It was not until the next day she took our daughter to the ER, for she was still throwing up! My attorney said that I have a good chance in getting them! Being a father I here all kinds of story's how the moms always gets the children, and that just scares me, thank you for your help.

Yes it is harder to wrest custody from the mother. But the best interests of the child is supposed to be paramount. Just the fact that the child ingested meds and wasn't taken to the hospital until the next day is a very strong argument.

Ok, I am back and here is what has happened. Our second time in court was April 24 and my soon to be x-wife tested positive for methamphetamine. The judge then gave me temperory custody. My wife see them the 1st, 3rd Saturday for 4 hours at a time. Out next court date is may 24. Should I fell good about getting my girls permittently our should I still be whirred!

I think you should feel good, but she will still probably get visitation. At some point, if she can prove she's clean she might regain custody. But the longer that takes the better you should feel.

I don't understand the comment "regain custody" she has never had custody. I filled for divorce on Feb 27 and my girl have been with me at all time! She has only had supervised visits, she has no job. She is doing nothing with her life right now. I am a working fireman who has been taking care of his girl. I don't see how a jugde can give her the girls after she a history of drugs. I am clean with no problems. Is that not count for anything.

First, yeah she did have custody. Until the initial divorce decree you and she had joint custody.

Second, I'm agreeing with you. Based on what you have told us, a judge is not going to grant her custody at this time. Additionally any visitation would probably be supervised. But we don't know what the future will hold. At some point she may clean up her act, and prove to the court that she is capable of caring for her children. This may be years in the future, definitely not anytime in the near future.
