    My sister and her ex are both fighting for custody of my 4 year old nephew my sister has asked if she gets him back living with her will I be his legal guardian but my nephew will still live with her I am confused over this cause I thought if I was a legal guardian the child would have to live with me any advice would be useful thanks

    Yes, a guardian provides for the child. It doesn't make sense for you to be a guardian if she gets custody.

    Right that's helpful thank you think I will be having him on temporary basis then till court case is over

    Well you do need something to allow you to authorize medical treatment if something should happen while he's in your care.

    Is the other parent going to agree to allow the child to live with you ?

    I think so as at the moment the child is with its grandoarent and she can't cope and the judge is asking for someone to.come forward
