My ex partner is taking me back to court baysically 3 and half years ago I took him to court because he was seeing his daughter then wouldn't come and I had enough of the stop start basis, so I wanted to get a order where he couldn't do this stop start contact. At court first of all we agreed to contact at my house again he would come then wouldn't come, so we went back to court and took me out of the picture so he was to see my daughter at my mothers again he would come then wouldn't, then he moved away for 6 months came back and wanted to start seeing her again of which we went back to court and went to contact center which once again same thing happened he would come and then wouldn't, so then the court decided to do a cafcass report of which he didn't turn up for his appointment, so when we were due back to court to hear the report etc he didn't turn up. So the judge said if he wanted to see the child again he was to apply to the courts and explain everything. So now 2 and half years of him not seeing his child and not trying to make any contact what so ever, he has applied to see the child stating that I stopped him seeing her. Obviously I didn't stop him it was himself that stopped him by being incontant and not stable. My little girl has got a very stable happy life and I don't want him to mess the life I have built up for my daughter up by 1- messing with her head and 2-coming and going when he pleases. Will the courts take into account all the messing about he has done and will they see that he is only after playing games? Also he has never since my daughter has been born paid csa because he keeps moving so they can't find him, he was violent towards me and he has threatened to take my child away from me. Also I am aware that he is working and claiming income support so he is getting legl aid whereas I don't get legal aid as I work. Any advice much appriciate

One thing I do know for fact is it is federal law that appendix A is incorporated with any and all custody cases and orders. Most courts do take these seriously and will up hold them as far as the law goes. But as her father depending on your state some are pro parents and some are for the mothers, and some for the fathers, it all depends. As far as legal aid... lol sometimes I think they are a joke, I was laughed at due to the cops not allowing me to file a report on my ex, but I still bare the physical scars, the witness, and the nightmares of being left for dead, while they drove him to the hospital to get his hand casted. So girl keep fighting for your little one, and what ever you do, make sure cause to her he is a strainger at this point in time, most courts will take that into consideration big time, but make sure that he is not allowed to take her any where from school or day care, home etc. she don't know him, and he is technically a "flight risk".
