    Test proves he's the father
    Dna test proves my son is the father of his child. The mother was married but separated for a while before they got together. The mother never got divorced.They had a baby together. Legally my son could not sign the birth certificate since she was still legally married. They are separating and the mother of the child says this is not his baby since he's not on the B.C. She wants to take the baby out of the country. We have a legal DNA test and we need to know what we need to do now to work on custody and make sure she doesn't get a passport for the baby. The baby's name has my sons last name on the B.C and the mother's last name is different.
    What can we do to establish my sons name on the B.C? We were told by others that the husband is responsible for this child and my son has no legal right to his child.

    Of course how long as went by since the child was born ?
    Is she still legally married?

    But if even possible, in some US states the husband is the father, in some, the real bio father may file an objection and ask for this to be corrected but they have a time limit to file.

    But he needs to hire an attorney at this point.
