My ex and I used to own the house together for one and half years. I did refinance a couple months ago to under my name only. We had oral agreement last December, 2011. We both agreed to move out by end of Feb. 2012. Now he changed his mind that doesn't want to move out. I had texted and emailed him the final date to move out couple times. He used to pay the half of housing expenses. He hasn't paid me for a month. I need to know can I just go ahead to file the eviction. And what kind the eviction order I should serve him? In the process of this refinance, did he sign over his interest in the property to you?

He signed the quit deed. That's why I was able to do the refinance.
