I'm not sure of the legal issues here... but suing a non-profit organization that gave you a house just seems wrong.
What kind of problems are there with the foundation? Have you obtained proper advice on the scope and nature of the damage? If the problems are serious enough, the first thing I'd do is see if this is covered under by builder's insurance or some kind of home warranty program.
If it was donated, probably don't have much of a case, particularly after 5 years. In the Atlanta Area, we only use slab on grade for HFH. What is happening?
I doubt this would hold up in court, you have no damages since you did not pay for the home. You have to show damages when you sue
Really, Habitat is a nice bunch of caring people, have you ASKED them for help? Politely and gratefully?
