    Asking a spouse to leave
    My spouse and I have decided to split after 10 yrs. Having my spouse threatens to move out all the time and hasn't done it. This has emotionally drained me. I do count on my spouse to pay certain bills but I can no longer handle being in the same house together. We are both on the mortgage but I pay it all. My spouse keeps saying that I can't put her out since she is on the mortgage. What are my options to get her to leave and yet hold her responsible for paying the bills that she pays until I can sell the house. Any advice would be much appreciated.

    A wild dream, you want to put her out and make her help pay the mortgage,

    OK, what you need to do is hire an attorney and file for divorce, and no you can not kick her out of the house unless she will willing leave without going to court and having a judge decide.

    Next who says you are going to get the house, she could well get the house and the judge order you to pay for it,

    Go see an attorney.

    It seems to me at the point that you decide to split up, cooperation tends to severely diminish between two people, understandably. Independent action becomes necessary. Seek an attorney asap as it only gets messier and messier from here. Keep your distance meanwhile. This shouldn't be about who is moving out, that's an unnecessary sidetrack unless you want a War of the Roses (did you see that film?)
