I have told my roommate that she has to move, she has been living with me for about 8 months and hasn't paid rent in 5 because she didn't have a job. Now that she has a job she lying to me about things she has to do to prevent from paying. She has not been home since I told her to move but she says her belongings can legally stay for thirty days and refuses to come to the house so that I can remove the things I've allowed her to use from her room. Is this true in Georgia.

It is true almost anywhere. Assuming you own the property or are the leaseholder, then you are her landlord and she is your tenant. As such you can't kick her out, you have to go through the formal eviction process.

What you should have done (and can still do) is give her a 3 day pay or quit notice. This gives her 3 business days to pay what she owes IN FULL or vacate. If she does neither, then you can go to court for an eviction order and force her to remove her belongings.

A verbal get out can be considered a notice to vacate which normally gives the tenant 30 days to vacate. But, if its not in writing she can fight that.

So I would give her a written pay or quit and proceed from there.

The issue is you can not make her move, even if she comes home without eviction.

You have to give them notice, to move, ( normally 30 days, but 10 days for non payment) if they don't move you file for eviction in court.
