My daughter's biological father is not around, he is on child support and he is a little over 5 thousand behind on child support. He hasn't seen his daughter in about a year and a half. I am married and my husband wants to adopt my daughter and change her last name. When I had my daughter I gave her my last name not her biological fathers last name. But in the court of law he denied her and we had a paternity test done and he came up as 99.9% the father. But he does not see her, does not pay, does not call.

You would still need him to agree to giving up his rights before an adoption can be done.
