    Confused about eviction laws
    I was living with someone and she never asked for help on bills. I stayed there for 3 months and she put me out while she was away on vacation. There was no verbal agreement nor a written agreement. She gave me 30 minutes to get out over the phone. Now she is harassing me about taking me to court. I was never given a eviction notice at all. What is the law on this in South Carolina?

    If she locked you out, YOU have grounds to sue her.

    30 days after you are notified to leave (in writing), you have to leave. You don't NEED an agreement, lease or be paying anything. SO you better start looking for a new place... you won't be here much longer. But as JudyKayTee stated.. she can't simply lock you out without proper legal notice.

    Let me get this straight. She called over the phone and told you to get out and you did? Then you have no recourse. She had every right to tell you to get out and you had every right to tell her no, that she has to evict you legally. But since you didn't do that and since you, in fact left voluntarily according to the law, then it was not an illegal eviction.

    What is she taking you to court about?

    Good point Scott, I miss-read it that she was actually gone. At which time it was voluntary and too late.

    Agree, when she told you to leave over the phone, you say NO, and don't,

    Since you left, there is nothing you can do.

    What is she threatening to sue you over now?
