I am currently a resident in PA but I was married and had a child in Delaware, can I file for custody in PA and go to court in Pa or do I have to file and go to court in Delaware?

Where is the other spouse? Who has custody of the child?

If you and your soon to be EX both live in PA no issue, you file in PA.

Ok Chuck me and my son live in Pa have had my son in my total care since July of 2010, no custody, he is just with me. My spouse lives in Delaware and I want to get a divorce and file custody papers. I hope this clears things up for you and thanks in advance.
