I got married to my baby's father 5 days after I gave birth to her in 2007. 2 months later I found out that he got another girl pregnant and we separated. We are still legally married but he gave up his rights to my daughter in May 2008. What do I need to do to get child support and get a divorce?

First I doubt he "gave up his rights" since it is almost impossible to do, and requires a judge to agree ( seldom happens).

So how did he exactly give up his rights, sounds like he was trying to so a scam on you to get out of paying child support.

You need to file for divorce, file for custody of the child and file for child support. He can if he wants file for visitation with the child.

If he gave up his rights legally that means someone else adopted the child and he is no longer the father.

If he is no longer the father you can't get child support.

You need to consult with an Attorney who will bring a Motion asking that he support your child. That will require DNA testing (Court ordered), of course.

Why are you staying married? I'd also divorce him .
