If I owe the hospital and they send it to a collections lawyer can they take my state and federal tax returns.

No they can not take your state and federal returns. If the refund hits your bank, they can take it if they have court order.

In North Carolina if it is a county-owned hospital (not a non-profit or private facility) I believe they can offset your state refund so this could be different for each state and type of facility.
