Hello,
I was backing out of the parking spot at work at night around 10:30pm. Hit another car that was parked at the no parking zone (i.e. With fire rout sign). There were lots of witnesses around and both cars had damages on them. I waited till the other person came out, she asked me not to call the police and settle the matter between us. She later called her husband to the scene who stated the work place is responsible for the damages on both cars.The work place told us that we are not covered and should settle it between us. Now the other driver wants us to go and report it at the police station after 2 days. What should I do?
P.S I took the pics of both cars at the scene though and I'm thinking that she does not want us to call the police because it was illegal parking

There is no point in reporting it to the police. This should simply be reported to both insurance carriers and let them deal with it.

Thanks for the response. Many people says that accidents on a private property is 50/50. I don't want my insurance to go up If we have to go through our insurance.
What I will like to know is should we fix our cars individually?
The other party is asking me to pay for her car to be fixed. Got an estimates for $1000, then who will pay for mine?
What should I do?

I don't know WHY you didn't think Scott was helpful.. He's just trying to keep you from making extra steps that you don't need to take. Calling the cops won't help get your car fixed any faster. The insurance companies have their OWN investigators, if needed. And, THEY'LL figure out who was in the wrong... After the fact, the COPS won't do that...

What you HEARD is wrong. You can DO like Scott said, and report it to your insurance company. If you don't want to do that, I wonder WHY you bought insurance in the first place.

If you only have liability, your insurance company will pay for HIS car. HIS insurance company will pay for YOUR car. That assumes it's NOT your fault... But, you ran into him, didn't you? That makes it YOUR fault, so you're going to pay for BOTH. Why should HE pay? He wasn't doing anything?

I'm going over to read the other thread but I'm a liability investigator. There is no law or rule that accidents on private property are 50/50.

I'd listen less to "many people" and more to the experts on AMHD.

It is possible that the insurance company (or companies) will demand that the accident be reported to the Police - happens with some companies in my area (NY).

YOU were the cause of the accident, not the other person. This is like saying that you ran over a pedestrian because he shouldn't have been standing where he was standing.

In many places, the police won't even respond to an accident on private property. They surely will not take a report 2 days later. That's why I said don't bother. I don't know what you mean by accidents on private property being 50/50. If you mean fault is 50/50 that's not true, fault is attributed based on the circumstances, physical evidence and witness testimony.

If you don't want to report it for fear your rates will go up, then pay what the other party wants.

What they mean by 50/50 is insurances consider them as both parties are at falt, and we can either go through our insurances or fix them on our own.

For what reason do I have to convince you, you are not the only person that is replying to me question why are you taking it personal instead of been professional.I'm only coating what I heard and trying to clarify with professionals. I leave in Ontario Canada, I was told that because he parked at the fire hydrant and besides there was no enough space for me to back out, although I miss judge the space that I have and I'm no saying that is a good thing that it happened.

If you hit someone that was not moving you are generally at fault. Whether he was parked illegally or did not give you room to maneuver is immaterial. Whether this occurred on private property or not is immaterial. You should have been aware that he was there and stopped moving.

So it would appear that you are at fault. If you don't pay, he can make a claim against your carrier. Or take you to court.
