    What section of CA civil code states that a tenant does not have to pay their landlord rent if the property is in the foreclosure process?

    Any landlord anywhere can collect rent for as long as they remain the owner of the property. Right up to when the auction is scheduled.

    CA Does have a law (see the stickies at the top of this forum) that requires landlords to use the rental towards their mortgage payments under certain conditions. If the landlord violates this laws, the tenant can sue to recover the rental.
