    Statutory rape. Please Help!?
    Hello, I'm 14 turning 15 in march my boyfriend is 18 and I have an aunt who really dose not like me and is threating me that if I do something wrong with her she's going to call the cops on my boyfriend I'm wondering if he can be charged with statutory rape? I've looked into it a little bit and from what I've found he can't be for the most part but I'm still worried about it.

    Maybe Its Not That Your Aunt Doesn't Like You.. Maybe It's the Simple Fact That Your Messing Around With A 18 Year Old Boy. Honestly You're a little Wrong On Your Part. You Shouldn't Get Mad At Your Aunt For Calling The Law, She Has Every Right.. He's An Adult And You A Miner! You Shouldn't Even Been Messing Around In The First Place

    Correction: she is not "messing around with" a boy. Assuming they are having sex, she is a child, having sex with a grown man. He is a pedophile and a felon.

    And I don't know what trade she is in, but I doubt that she is a miner. She is, however, a minor.

    As well you should. If you would tell us what state or country you are in we could look and see what the specific law is, but chances are he is guilty of statutory rape. That is, as I indicated in my above comment to BayBaysSister, a felony.

    I don't think so I beleave that the law says that in between 5 y3ars different its not statuory rape if you're not having sex.

    You are sustantually correct; there are close-in-age exceptions to the age of consent of 16 in Canada:

    "There exist two close in age exemptions, depending on the age of the younger partner. A youth of twelve or thirteen can consent to sexual activity with an individual less than two years older than them (sic). A fourteen- or fifteen-year-old can consent to sexual activity with a partner who is less than five years older than them (sic).[8]"

    So the law does not prohibit the relationship in any event, if you are not having sex. The exception is immaterial. But even if you were having sex, the exception would apply in your case.

    I'm just concerned on what could happen because my aunt is threating me with charging my boyfriend but my parents are toldly fine with him.

    Next a 14 year old child has no business dating a 18 year old adult. But there are plenty of other laws, I am sure they can find to use other than rape

    151 (Sexual Interference), s. 152 (Invitation to sexual touching), s. 153(1) (Sexual exploitation), s. 160(3) s. 173(2) (Indecent acts)

    As for as that goes, if your Aunt has custody over you, or if the person who does, merely orders the 18 year old adult, to stay away from you, and he comes around, they can get a order of protection against him, if he takes you anyway, even perhaps kidnapping or at least interference with custody.
