My son just was released May, 2011 after spending 6 years in prison in NJ. He got 5 yrs parole. I let him move in with me. I am his mother. He made an all out effort, but one night went to give a friend a ride home from a sports bar and had drank less than 2 beers. He was stopped and was honest with the officer. He registered at .08 and ticketed. He told his parole immediately and was given house arrest with a 12 to 5 time frame to go to parole, the doctor and therapy. He then came up with a dirty urine and a stricter restriction was given and he could only leave the house to go to important appts. On New Years he became ill with appendicitis and was operated. He was sedated with oxicondine and left the hospital with a prescription of percacets. The hospital took his bracelet off while he was under sedation, but he called his parole and the parole came and replaced the strap. He showed him the paperwork showing the meds he was administered while in the hospital. The officer told him he wanted him to go to addition therapy for mental health and get his meds because he was struggling with depression annd bipolarism. Shortly after, he complained to me late one night that the bracelet was bothering him in addition to the pain and he couldn't sleep. 2Am he took the bracelet off and fled. He started doing drugs and said he was afraid because he didn't want to go back to prison. The parole came to the house around 3:30 AM. They waited for him to return. He never returned and after two weeks of being on the run he was found and arrested. Luckily he hadn't committed any crime. I was told first by the parole that the worst scenario was he could get 1 yr in jail but that he would probably get that combined with rehab. Now I am told he is going back to prison. I am devastated. What can you tell me. The parole said he probably won't spend too much time in prison and it could include mental and substance abuse assistance. I thought that he wouldn't go to prison because they said first jail was probably be his fate no more than a year at the worst. Now the parole says its out of his hands.

Most likely he WILL got straight to jail.

He actually did commit a crime when he removed it. That's a crime in itself. With his other failures to stay clean, they are going to to throw the book at him rather then being lenient. And he was on the run for two weeks... that's not going to endear him with the courts.

In Georgia, he would have an additional charge of "escape" and depending on how it took it off, damage of property.

He would most likely have to return directly to prison, and then have a parole hearing since he is out on parole, they are much tougher than probation. Even how many years is left on his parole he will most likely be ordered to serve the rest of those years back in prison.

In Georgia, most likely he would get another two years for escape, BUT> if he has two or three years left on Parole, which is now prison time it would all be served at the same time.

Yes the courts are not going to be nice, in fact most likely his parole officer will have already gotten into some trouble for being too nice with too many chances. So at court, don't expect him to be on your side either ( my guess)
