Recently I found a note that was very disturbing that my brother had wrote about me. And then later that day I found a memory card that belongs in a camera that recorded him hiding a video camera in my bedroom closet and it clearly shows him putting it there and then minutes later me walking into my bedroom after I had showered. And you can see everything . Now I told my mother and my brother disappeared for a few days and finally came home and my mother said she would go to the police about it and get this sorted out. She has yet to do anything about it and lets him stay in the house which I am not comfortable in with him there. She said she has done everything and what else can I do she says.. She will not go to the cops! Should I go to the police? Is it to late and what will he be charged with! Is it worth it will anything happen? I'm scared to go to the police because my mom will be angry at me and will most likely kick me out of the house! I have no where to go and I do not have the money right now to get me a place of my own

Yes, you should go to the Police. You have no idea what he will do next.

Yes you should go to the police, she can not just throw you out of the house. Evict you though formal proceedings yes, but not just kick you out.

If you mom prefers to keep your brother instead of you after this, she has some serious issues also.

Go to the police, if you don't feel safe then that's the right thing to make you feel safe. He cannot get away with that, its disgusting and wrong, you have your rights, and for that to be video taped without your knowing is illegal anyway, so the best thing is to get help. Your mother should understand, your brother should be the one scared of getting kicked out.

I doubt that a crime has been committed. Some states criminalize the recording of one person without his or her knowledge, so such a statute might apply.

Laws on this are just developing, so its hard to say what he could be charged with if anything. Its possible mom did go to the police and was told nothing could be done.

You also don't say how old your brother is nor did you indicate your general locale as asked.

One thing you can do, is ask your mother if you can put a lock on your bedroom door. Generally peeping toms are not violent and won't go any further. So a lock on the door should prevent further invasions of your privacy.

My assumption was that she had the video. But that would be a concern.

There is a lock on my door and he knows how to pick locks and he is 15 yrs old and I live in canada

Get a stronger lock.

I couldn't find any specific criminal law against this. But there is civil law, but what do you think would be gained by suing your brother?

Given his age, this sounds more like immaturity than criminality.

There is Canadian Law which covers this (unlike the US which varies from State to State) AND the age of the offender does not seem to matter: ""Every one commits an offence who, surreptitiously, observes - including by mechanical or electronic means - or makes a visual recording of a person who is in circumstances that give rise to a reasonable expectation of privacy, if the person is in a place in which a person can reasonably be expected to be nude, to expose his or her genital organs or anal region or her breasts, or to be engaged in explicit sexual activity; the person is nude, is exposing his or her genital organs or anal region or her breasts, or is engaged in explicit sexual activity, and the observation or recording is done for the purpose of observing or recording a person in such a state or engaged in such an activity; or the observation or recording is done for a sexual purpose."

It's the 2009 Criminal Code of Canada, Section 162. I would post the site but for whatever reason it only partially loads.

What the brother has done IS a crime and if he has shown the tape to anyone OR used it for "self gratification" it's ANOTHER crime. I think someone needs to get that tape (which the OP may or may not have) and read the riot act to the brother.

The mother won't be quite as blasé when the brother videotapes her (the mother).
