    What do you do if someone claims a dependent without consent?
    My daughter was claimed as a dependent, but they don't have consent.
    What do I do?

    It sounds like the other parent is claiming her?
    If you are the custodial parent, just claim her and file your return. If the other parent e-filed already, you might have to file on paper. The IRS will then determine who is eligible to claim the child and might ask for supporting information.

    If you have the legal right to claim the child, do so, you may not be able to file electronicly, but you file. Include documentation that you are the rightful one to file.

    This has become a more frequent complaint with the advent of electronic filing. Someone files electronically first claiming the child. This blocks anyone else from filing electronically, but it does not block you from filing a paper form. So file your form and let the IRS straighten it out.
