    Felony probation violation
    HI my boyfriend is incarcerated on two charges but when he went to court today the DA refused to prosecute however instead of being released he has a court date set for tomorrow for felony probation violation what I don't understand is how they can violate him if the charges he was incarcerated for were bogus and he has not had any police contact he was arrested by his probation officer when he went to check in due to these false accusations

    First the DA not prosecuting and it being a false charge is two different things, in this case it may be, but then it could be there is evidence but not able to use it in a criminal trial, but would be able to be used for a probation violation.

    But many people get their probation violated even after the criminal charge is droped.
