I haven't been able to afford to pay my Probation as I don't have a job any longer. I have explained that to my Probation officer although now a warrant has been issued. My backup sentence is for 1 year. I want to know what can I do now if I back pay my Probation or something if it will be removed I've called/email/wrote letters to my Probation officer and I'm not getting any responses. What else can I do to assure I won't go to jail?

You choices are to complete the terms of probation (and that appears to be to make restitution OR pay whatever your State charges for the work involved in your probation) OR do the one year sentence. If a warrant has been issued it's really too late to change anything.

I'd surrender on the warrant WITH an Attorney and see what happens. If you are picked up you have no chance.

That would have been find ANY job ASAP to have continued those payments without interruption. You were in violation when the first one was late. And what state would this be. Some states are more strict than others, it will help others give a batter answer, too.

However if a warrant has been issued already, that means its in the courts ballpark now. If you have a lawyer, get in touch with them, so they can go with you to surrender and possibly work something out on your behalf if you are lucky. The longer that warrant is out... the worse it will be. Particularly if you are picked up by the cops.

Question? If you couldn't pay them back then, how can you pay it back now?

Part of probation is making you play by their rules as much as it is about the money.

You will go to jail at this point and time for the VOP. If prior to the hearing with the judge ( my guess one week to 3 weeks after turning yourself in) have the fees to the court caught up.
