    H1B Visa Tax Filing
    I am citizen of India and I came to US for my MS in Fall 2008. I graduated in Dec 2010 and was in OPT till Oct 2011. I got my H1B Visa from Oct 2011.

    Can someone please let me know what forms do I need to use to file my federal and state taxes?

    Can I file my taxes online through Turbotax?

    Also will I be eligible for the std deduction?

    If you are not married, you will file federal nonresident tax return.
    You will also pay state income tax for income earned in a state.

    Since you are from India, you CAN claim the $5,800 standard deduction on your non-resident tax return (Form 1040NR or 1040NR-EZ).

    Note that, if you file as a non-resident, you must also submit Form 8843 one LAST time.

    @Atlanta Tax Expert: Thank you so much for the response, I am not married so I will just have to fill and submit Form 1040NR or 1040NR-EZ and Form 8843 (just this time). I am from Kansas can you also tell me what will be the form to be filled for filing state tax. Do I have to fill the same form every year for filing taxes?

    You WILL have to file the Kansas return (as a non-resident due to your international student status),).

    The form is K-40 with Schedule S.
