    What do I do first to move out of state with children?
    I am divorced with custody of my daughters. I also have an older son. I have decided to move to be with my sons father, but he lives out of state. My ex-husband has disappeared and I have no way of contacting him. His family doesn't know anything about him either. Does anyone know what legal action I should take first? Thank you for your help.

    You will need to file a motion in court where you have custody asking permission to move.

    If there is no court ordered visitation then you are free to move. If there is a visitation order in place, you should get permission of the court. Given the circumstances it should be granted without a problem.

    If there is no court ordered visitation I would still send a letter to the court explaining that you have no way to contact the father, but you wanted the court to know you were moving and here is my new address.
