How to cash out of an estate with sisters
I have a situation where I am one third owner of a piece of real estate (home/land). It is the remianing piece of my mother's estate. My two sisters and I are co-owners of the property / estate. One of my sisters is currently occupying the home. I would like to determine if there is an easy way for me to take my one third equity in the property now without alienating my sisters.

'Take' equity? No easy way. Generally whoever wants the place buys the other(s) out, and if that doesn't happen, the place sells and the proceeds are split. This all assumes the will didn't specify anything about any of you being able to live there for a period or life. Who is executor?

You could talk to a bank about a line of credit with the sister living there paying it back, or a reverse mortgage (if all of you are over 62), or some other creative arrangement among you 3.

Yes, one or both of the sisters need to buy it from you.
You have to ask them. Also the one sister living there needs to be paying rent to the other two. Reduced by her percent of ownership. But the other two are entitled to payment for her use of their property

Call a family meeting discuss why your feelings and then allow everyone else to put their two bits in and go from there but remember to put "God" first and everything else will fall in place.

    God Bless you.
