My daughters fiancŽ is in hospital and has been for the last 10weeks after being beaten badly by a group of thugs, the doctors have told him he will make a 85 percent recover. The family of her fiancŽ doesn't want her to visit him anymore. Can they do that by just asking the nurses there to stop her when she goes in? She has never caused a scene there, she has had confrontations away from the hospital though as the family don't like her being with him and don't like her. What are the laws on this, as at one hospital he has been at, my daughter is next of kin, but at another, the mother of him is next of kin. Its all so very confusing and hard to find the right answers and laws on any of this

If he is awake and in possession of his faculties, then he controls who visits. If not, then someone was appointed guardian for him and that person controls access. Whoever is in control can dictate visitors.

She has no legal relationship with him, since they are not married yet. If he did not leave any paper work granting her any rights, she has none at this point.

It's really up to the patient if he is capable of speaking and reasoning

My guess is that the first hospital was confused and got the idea that she was his wife.

This is not entirely true - if the parents tell the hospital not to allow her in the HOSPITAL has to decide if he is capable of making the decision.

I went through this with a stepdaughter who continued to visit her dying father, sobbing and wailing and throwing herself on his bed, upsetting him, trying to get him to consent to all sorts of thing ("Promise me I can have your car." for example.) I ordered her OUT! My husband nodded when asked a question - ANY question. She stayed out.

It was a rough time. I don't blame her. She is a very emotional person and just went to pieces - repeatedly. It upset my husband. It upset me. It upset the hospital staff.

She stayed out.

I, of course, had his Power of Attorney but still - the visitor upsets the hospital routine and the hospital sides with the parents.

I don't see her getting in to see him. She is NOT his next of kin. Is this a formal engagement, do they live together, is there a wedding date, something else? My experience was that people who are dating someone who is injured is suddenly the "fiance."

Why specifically doesn't his family want her there?
