    Is this a contract signed under false pretense?
    My wife signed a service document for garbage pick up, but was not told it was a contract and was not given a copy of the so said contract. The document she signed was what she understood to be a bin delivery slip. We wanted to terminate the so called contract (which we did not know we had) and were told that we are under contract. We had 2 years left on the so called contract and now have been taken to small claims court for the 24 months remaining in the contract in the amount of $1900. Is this a contract signed under false pretenses?

    No, if she had the ability to read it, so you need to get a copy of what she signed, if it says there is a contract, then it is a contract. Does not really matter what was said or not said prior to her signing.

    Next it is easy, she should have required a copy, her poor business choice does not make it a fraud.

    So now you need to get the trash company to send you a copy of the contract. If it is a contact, then you owe them the money.

    I will assume you terminated the trash pick up and stopped paying them, thus you went into default and now owe all fees, late charges and court fees.
    If the paper work stated contract, and stated the time frame for it, you will have to pay.
