    Rights concerning child's last name.
    I'm soon to be a daddy in a few months, his mother and I are no longer together and in separate states (Illinois and Washington state). It's looking like I'm going to have to petition for paternity because his mother has been entirely unreasonable and irrational since week 18 of her pregnancy. Anyway, to cut to the chase, I'm wondering, do I have any say in what my sons last name will be? I'd like for him to take mine as hers is still the same as her ex husbands. I don't want my child to have another man's last name, especially not my son. Please help!

    Is she married to this other man ? But she has full right to name the child what she wants. After you file for paternity, you can petition the court for a name change, but it is hard to decide what the court will or will not allow.

    No they are divorced.
