    First what type of crime, some crimes such as DUI have required jail time, so probation is not a option expect after jail time.

    But a person convicted of a crime for the third time often gets probation if the crime did not include a weapon or if the crime did not include any physical harm to someone else.

    The facts the crimes were from another state makes no difference.

    Your prior convictions will definitely play a part in your presentence investigation and the level of your current charges. This is all figured out in a formula for your sentencing.
