Do I Have to Tell My Employer I Have an embezzlement misdemeanor charge?
I went to my probation officer today and she told me that I have to tell my current employer (that I've had since before my conviction) that I have an embezzlement charge. But even on my application they never asked if I had an misdemeanor nor did they ask if I had a pending charge. Just if I was a convicted of a felony. Which I haven't. It was supposed to be a felony but my plea bargain stated that it's a misdemeanor and that was the conviction on my paperwork. I've done all the thing needing to be done except finish my probation. But I've paid the fees, I did my time in Jail. I just want to be able to keep the job I have and make it through this holiday.

Is your present employer in the same industry/business as the company you embezzled from? As far as I can see, you should not be forced to disclose this information unless this is part of the written rules of your probation.

The PO has and often do call to confirm employment, in fact the PO is allowed to go and do a job visit. They normally don't. You may want to discuss this with your attorney as if they can force you to tell, but again if you don't, nothing stops the PO from showing up at the business and asking to see you.
