Ok he does not file for child support. YOU do, so did you ever go to court and get a custody order giving you custody of the child ? Did you ever go to court and get court ordered child support ?

Next it is not something you "file" you can use it as a reason to ask for a modification of visitation rights, may even use it in some areas to ask for a new partner to be able to adopt.

If you did not file for child support, he does not even owe you a penny.

As Chuck said you don't file for abandonment. Please read this: https://www.askmehelpdesk.com/family...st-364259.html

Then tell us what you really want and we can advise.

So what do you really want to do ? Does your husband want to adopt ?

If you have never filed for any support or any custody, there is nothing you can go after him for, expect to file and try to find him.

If your husband wants to adopt. You will need to hire an attorney, still try to find the bio father, but all of this may be enough to get the adoption though.
