No, it is badenhope and it is a TN case that may also not apply to other states. I see no US supreme court ruling on this. Next it dealt with some specifics in the bio father did not prove certain aspects to his petitions to the court. Had he proven his points on his petition, he may have well won. Or had the bio father stepped in at the death of the month, the case would have sent different also.

So this case is merely a ruling in very limited cases as to who gets custody.
