There is a sticky at the top of this forum that answers your question. Whether it is considered abandonment or not is not important. The question is what do you want to do about it?
Who at this time has legal guardianship? How has this child been taken care of for a year ?
Her father/my husband. He also has custody.
I guess I can't see the "sticky". Have her mothers rights completely taken away.

You are not likely to get her rights terminated. There is also a sticky about that.

So do you wish to adopt the child, this is the only way to take the mothers rights away. Even with no contact it will not be easy, and would work better if she will sign her rights to allow adoption.
But you can use abandonment for a reason to go to court and ask for a change in visitation, to modify the current court orders.
