    Can a room-mate kick you out if you are on the rental lease in Texas ?

    Swing the toe of his boot against your backside until you move? Probably not.

    Ask you to leave? Sure.

    Go to court and get the judge to order you out? Depends on whether you violated the terms of some written, verbal, or implied contract between you with respect to the leased premises.

    If you both are listed on the lease as equal tenants, then No. Neither of you can kick the other out.

    If you are only listed as an occupant, then you are not a leaseholder and can be LEGALLY evicted.

    If he goes to the landlord, the landlord might not even be able to get rid of one of you, he might have to get rid of both.

    In any event you cannot be forcibly removed without a court order. That would open them up for an illegal eviction suit.
