Ex-boyfriend is taking me to court for damage to his possessions
Ex-boyfriend walked out of house after starting a domestic dispute. Did not hear from him for almost a month. Put all his possessions in driveway under a tarp. Family came and removed whatever they wanted from the driveway leaving driveway a mess. Now he is sueing me for $5,000, for damages to his things and accusing me of letting his things get stolen. Do I have recourse and can he legally sue me after leaving his stuff in my driveway for over 30 days?

Did you give him written notice to pick up his things and what you were going to do with them if he didn't?

If not, then he could win.

If "family came" means YOUR family came and took his tools there could be criminal charges filed, if he wants to go that far.

You cannot simply dump his belongings, unprotected. As Scott said the way to go legally would have been a letter to him.

I'd ask the "family" to return his belongings before THEY get charged. There appears to be little question that the belongings were not abandoned and, therefore, available to be grabbed by someone else.
