    What are my rights as a landlord
    Can I give a tenant a pay or quit notice and go to the court house the same day and get an unlawful detainer since the court house takes more then 5 days to give me a summons

    It depends on where you live. We have copies of all the states landlord tenant laws on a sticky note on the real estate page...

    But, in general, you need to wait until the pay or quit expires before you can file suit. However long your court takes, is what you'll have to deal with. Ain't no fixing that.

    In areas where I have had rentals the unlawful detainer could be thrown out if you apply before they have their five days to pay or quit.

    I agree with the previous answers. But I wanted to add, that when you decided to become a landlord, that is when you should have researched all the laws and regs involved.

    You typically give a notice to pay or quit. You need to wait until the time runs out to pay to file.
