I am the oldest of 3 children, Mom has past away 16 yrs ago and our Dad has paid all but about $12,000... All 3 of us are in our 30's, is there a way to get the case dropped?

So if your mom is dead, to whom does your dad owe the CS?

Yes you can do it several ways. If he was / is paying to the child support collection division. Then prove who the money was to go to and sign off as paid in full. Then the case will close. If it was equal to all 3 of you then the 3 of you will hive to sign off on it.

It is owed to the estate and passed along as an asset of the estate.

Exactly... we don't need the money. We just want to get the case dropped.

The case itself is over if you are in the 30's, all that is now due would be back child support not paid when you were minor children.

Your mother, her estate and a guardian if they raised you till you were old enough not to be under the court order.

But the three children, not adults could hire an attorney together to attempt this, but again all three of you will need to agree with this.

IF your mother was on state aid (Welfare) during the time your father owed child support, you may not be able to get it dropped. He would be paying the STATE the back child support, as the state was supporting you when he wasn't paying.
