Ok here's the deal. I met these two girls in August and they were very interested in the apartment. I have a two bed one and a half bedroom that at the time, I was renting a room in. I signed the lease before I met them and I paid the deposit both totaling 1000 dollars. I made them pay a ridiculously small deposit which actually was considered half of the first month's rent also. They said they would pay their rent all the way up until they left which is in February, we met in August. Let me tell you I was scammed beyond recognition. The first month they paid rent and utilities on time but the three months proceeding have been a nightmare. They can't get it through their skulls that things have a pay by date, rent and utilities that are in MY name are constantly late and we have had the eviction process started on us TWICE because of them! After finding out that one of them was sleeping in my room while I was away and leaving trash i.e. a condom wrapper underneath my dresser! I agreed to just let them sleep on my bed because I still paid rent there I was just staying with a friend instead of being there. I've also had to pay portions of their rent because they "didn't have enough" I soon found out they were spending hundreds on clothes and electronics and speaking ill about me to their friends. The apartment is a wreck its poorly unkempt and I keep getting rude calls from my rental agency about partial payments (their only getting my payments on time) I always have to ask or remind them about rent and I'm tired of it. Their sisters and they both "say they have jobs" but their late for rent and utilities every month! I'm moving out soon cause my lease is over with but I want them out now, I have someone whose willing to pay up their portion of the rent until the lease is over because I'm tired of these free loaders. So can I give them a 30 day notice?

Which is it? Your lease is up or it the lease is over soon?

You didn't say what state you are in, but chances are that you can evict them (ask the court to order them out) if they fail to leave after you give them a 30 day written notice.

" I signed the lease before I met them " so you initially had the expectation of paying the whole rent, if eviction started it was because you failed to pay on time. The roomates should not/do not pay rent to the landlord, that's on you. Tell us where you live and maybe we can give more advice.

Since you are the one on the lease, they are YOUR tenants. If their rent is not currently up to date, then gave them a pay or quit notice (see your area's laws (ANY question on law needs to include your general locale as laws vary by area.) for the deadline on the pay or quit. Then they have to pay by the deadline or move out or you file for eviction.

ballengerb1: seriously? Who would let two strangers live with them and pay their way? Your missing the whole gist of the situation. Their NOT paying rent rather its to me OR the rent office. And their NOT paying utilities either! The only place you can live for free is a homeless shelter and your relatives house and I am neither. Chelly, When you post on a site like this you open yourself up to any comments as long as they don't violate our rules. If you feel they do violate our rules then use the Report Inappropriate Post (RIP) link to report it. If you insult people in response then you will have violated the rules.

Ballenger reacted to what you posted. You took the apartment on your own. Whether you did so with the expectation of getting roommates or not was not clear in what you posted. Therefore, it was and is YOUR responsibility to pay the rent and utilities. It was and is your responsibility to collect rent, etc. from YOUR tenants.

YOUR landlord apparently wasn't going to accept late payments based on your statement that twice they started the eviction process. So why didn't you start the process in turn? That's the point Ballenger was making and why he didn't deserve an negative rating.

So your reaction to his post was undeserved. As AK pointed YOU have let your roommates live free for not taking the action you should have taken immediately. You need to understand and remember, that everyone here VOLUNTEERS their time and expertise to help others. So when you demean their effort to help they do take it personally. If there are any more put downs or arguing by ANYONE, further action will be taken.

Finally, your father's lawyer is only partially correct. You may not have to wait 30 days. If your tenants are not up to date on their rent then GA law allows you to serve them with a 3 day pay or quit notice. If they don't pay all they owe within the 3 days, then you can go to court for an eviction order immediately after the 3 days are up.
