If you are in the US you have to file a lawsuit for eviction in the county court of the county where the property is located. Once you've filed a complaint and the tenant has been served the court will set a date for trial. At the trial you will present proof that you are the landlord, they are the tenant, they failed to pay rent when due, you gave them a written notice to pay or leave, and they failed to leave.
