    Can someone get a restraining order based on a threat?

    Hello rysco:

    If it was as easy as that, all you would have to do is check a box on a form. But, it isn't. The only way to know if you can get a restraining order, is to apply for it. A judge will listen, and make a decision.

    Yes. When a restraining order is applied for, the judge listens to all the evidence and decides whether a restraining order is warranted. The nature of the threat, the likelihood of it actually being carried out and the suspect's past record will all come into play as the judge renders his/her decision.
