Adoption of a step-child by stepmother when biological mother is not present.
My husband was granted custody of his daughter in 2009 after the biological mother was reported to children services and ended up failing the drug tests given through dcs. Following that, came removal of the child. My husband and I ended up getting full custody and the mother was given 2 supervised visits a month for 2 hrs. The child was removed d/t a burn on her hand when she was approx 9 months old. The mother could never explain how the burn occurred. The mother attended a few of the visits but always showed up late and left early. Half the time she seemed to be under the influence of "something". She never passed a drug test. She was ordered to pay child support but it only lasted a few months now she is around 5,000 behind, just an estimated guess. After a while the visits just kind of faded away and eventually we just told her to stop calling or texting because she always made broken promises and we could be using our time wisely doing other things as a family. So she did just that... actually she moved to another state and we have not saw her since the summer of 09. We do occasionally receive a text from her telling us to let her daughter know she loves and misses her but the child is almost 3 and has many behavioral problems. DCS had stated that the mother was possibly putting OTC meds in her bottles to make her sleep which is most likely in connection w/ her delay in development and behavior problems. Not to mention the court terminated her rights to her first child and closed the case. So... longer story made very short, are our chances of termination/abandonment plus adoption seeming very likely in this type of situation?
