I'm a nurse, and was accused of violating HIPAA laws... what will happen?
I am a home health nurse, and am being falsely accused by a disgruntled parent of talking about another nurse, and my current pt in her home, when actually it was her talking about the nurse and patient... basically it is my word against her's... now my agency says they have to report this to the state, and it will be investigated because it is a hipaa violation... it is only my word against hers... what will the board of nursing do? In 18yrs of nursing, I've never had 1 disciplinary action, complaint or anything to the board...

    It's HIPAA, not HIPPA.

I post on the legal boards but legally speaking I would say that if you were talking about (I would assume they mean criticizing in some fashion) another Nurse the people you were discussing the subject with would have information which could not come to them in another fashion - or not.

I don't see the Board of Nursing doing anything to you. If it is determined that it's true the action would be against the service which employs you following a fact-finding investigation.

Here is information on violation of the privacy rule - Summary of the HIPAA Privacy Rule

Other medical care professionals have posted that they violated HIPAA, were terminated, went on to get another job.
