Is it a crime or just an incompetent mother?
I had just picked up my children from their mother's, and my daughter showed me that her mother given her an old cell phone. Well, the last time she had gotten one from her mother, there was inappropriate language on it, so I decided to look through the new one. What I found was disgusting, and I'm glad my daughter did not find it first. There were penis pictures, breast pictures, sexual conversations with three or more people. I live In Kissimmee FL and would like to know what my options are to handle this.

    Delete the objectionable material.

No, it's probably not a crime, unless the mother knew the images were on the phone when she gave it to the child. And you are not going to be able to prove that.

And it's doubtful that giving pictures of private body parts to a child is a criminal act anyway, unless doing so was intended to arouse lustful ("purulent" is the word most often used) thoughts in the child. Do any of these images suggest that children were present when they were recorded?

If it was her phone, she is free to exchange naked photos of herself with others. Giving it to a child is wrong, but she may have forgotten the photos were on it.

And since you deleted it you don't even have proof

Another thing that may be going on is ignoracne. Many people don't fully understand the technology they use. The phone could have been sync'd and even if mom erased whatever was on it then it would have returned to the phone because of it.
